The Defendant was charged with Intimidating a Witness, a Class C felony, under Hawaii Revised Statutes (HRS) § 710-1071(1)(a) (1985). Thereafter, the State and the Defendant entered into a plea bargain. The plea bargain provided, in pertinent part, that the Class C felony would be reduced to Terroristic Threatening in the Second Degree, a misdemeanor, and that the State, at sentencing, would be allowed to "argue for jail." At the hearing to receive her guilty plea, the Defendant affirmed that she understood the plea bargain, that one year was the maximum term of imprisonment on the misdemeanor charge, and that the court could impose a sentence it believed was appropriate under the circumstances.
